Instrumenty OECD na styku prawa antymonopolowego, polityki podatkowej i prawa pracy. Globalne standardy na rzecz uczciwych rynków
Streszczenie w języku polskim
W dobie gwałtownego rozwoju gospodarki cyfrowej istniejące regulacje prawne w coraz większym stopniu okazują się nieadekwatne do współczesnych realiów. Nowoczesne technologie umożliwiają świadczenie większości usług na odległość. Przepisy, które przez lata regulowały lokalne świadczenie usług, były tworzone z myślą o działalności gospodarczej opartej na fizycznej obecności i ograniczonym zasięgu terytorialnym. W trakcie projektowania tych regulacji nie można było przewidzieć gwałtownego wzrostu usług online ani ogromnej skali handlu elektronicznego, jaki mamy obecnie. Całkowita zmiana modeli biznesowych przyjętych przez znaczną liczbę przedsiębiorstw, w tym przez korporacje międzynarodowe, stała się poważnym wyzwaniem dla ustawodawców, którzy muszą dostosować istniejące prawo do realiów szybko zmieniającego się świata. Proces ten jest szczególnie złożony ze względu na ryzyko znacznych strat w dochodach podatkowych państw, w których przedsiębiorstwa te mają swoje siedziby. W rezultacie obecnie obowiązujące przepisy można uznać za przestarzałe i niewystarczające do prowadzenia działalności gospodarczej w XXI w. Sytuacja ta generuje istotne wyzwania systemowe i podkreśla skalę trudności związanych z opracowaniem jednolitych, globalnych regulacji prawnych. Ich wdrożenie wymagałoby międzynarodowego konsensusu, który uwzględnia interesy wszystkich państw i zachęca je do przyjęcia oraz stosowania wspólnych zasad. Wprowadzenie nowych regulacji zmieniających mechanizmy opodatkowania wywiera istotny wpływ również na konkurencję rynkową oraz na prawo pracy, co zostało wykazane w niniejszym artykule.
